Over the guy who dropped dead at the feet of one of its guides in the scalding Utah desert last summer. Get this:
It has since emerged that two of the group members were offered and accepted water from instructors on the trek. Buschow was not given the option.
The school said that by signing a waiver, “Mr Buschow expressly assumed the risk of serious injury or death prior to participating.”
Waivers are shredder bait if there’s negligence involved.

It’s interesting to me that the hike in question was only about six miles — but to do it in the hot sun without water is beyond stupidity. Even beyonder: Having water and not giving any to somebody who’s at the end of his rope.
Good! This company, and the guides involved should be taken to the cleaners over their incredible incompetence.
No waiver absolves the guide/company when the guide failed to perform the most basic aspect of his job–look after the safety of the client. A desert guide who doesn’t recognize severe dehydration deserves to take a legal beating.
I still can’t believe that criminal charges weren’t filed!
